BILL OF INDICTMENT - ACCUSATORY CRIME - [concepts] [full]

 

The Public Ministry of the State of Rondônia, presented a bill of indictment - accusatory crime, with fulcrum in the article 416 of the Code of Penal Process, against the defendants below described:

1. Cícero Pereira Leite Neto and Claudenir Gilberto Ramos:

a - for the death of the victims Ronaldo de Souza and Rubens Fidelis Miranda, as liable in the penalties of the article 121, § 2nd, item IV of the Penal Code;

b - for the maintenance of the peasants in regime of private jail, subjected to the penalties of the art. 148 of the Penal Code;

c - for the association in an armed gang, previously and with unit of intent of the specific end to commit crimes, application of the art. 288, single paragraph, of the Penal Code;

d - for the opposition to the execution of the act of judicial evacuation, the penalties of the art. 329 of the Penal Code;

2. José Ventura Pereira:

For the death of the victim Sérgio Rodrigues Gomes, the application of the penalties of the art. 121 "caput" of the Penal Code;

3. Vitório Régis Mena Mendes, José Hélio Cysmeiros Pachá, Mauro Ronaldo Flores Correia, Claudenilson Alves, Daniel da Silva Furtado, José Emílio da Silva Evangelista, Vilson Luiz Pedon, Luiz Carlos Fernandes, Airton Ramos de Morais and Moisés Oliveira Lima:

a - for the death of the victim Ercílio Oliveira Campos, the penalties of the art. 121, § 2nd, item IV, of the Penal Code;

b - for the death of the victim José Marcondes da Silva, the penalties of the art. 121, § 2nd, item IV, of the Penal Code;

c - for the death of the victim, identified as "H05", the sanctions of the art. 121, § 2nd, item IV, of the Penal Code;

4. Geraldo João Rodrigues:

For having fired a shot from a weapon of high caliber against the victim Moacir Camargo Ferreira, it pleads for the application of the penalties of the art. 121, § 2nd, item IV jointly with 14, II of the Penal Code.
